Terms of service

1. GENERAL TERMS

By accessing or using the Talenten.vn website, any services, or any applications provided by Talenten.vn (“Talenten”), collectively referred to as the “Services,” whether accessed in any way, you agree to be bound by these Terms of Service with Users (“Terms of Service”). The Services are owned or controlled by Talenten. These Terms of Service affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Service, do not access or use the Services. If you have any questions regarding these Terms, please contact us at email: admin@talenten.vn.

We may update these Terms of Service from time to time for legal reasons or to enable the proper operation of the Talenten.vn website. Any changes will be notified to you by an appropriate notice on our website. These changes will apply to the use of the Talenten.vn website. After we have notified you, if you do not wish to accept the updated Terms of Service, you should not continue to use the Talenten.vn website. If you continue to use the Talenten.vn website from the date the Terms of Service are updated, you must accept Talenten’s Terms of Service by choosing to agree through the notice displayed on our website when the changes take effect.

2. DEFINITIONS AND EXPLANATIONS

  1. Talenten.vn Database or Talenten.vn Databases include all job advertisements posted on Talenten.vn websites and/or all information of Users and/or registered employers with Talenten.vn.
  2. Talenten.vn Profile Database or Profile Databases are profiles of Users initiated and/or posted in Talenten.vn databases.
  3. Talenten.vn Services are any services provided by Talenten.
  4. Personal Profile is the information, personal CV created by Users.
  5. Text includes all text on every page of the Talenten.vn website, whether author-identified documents, search-oriented content, or instructional information.
  6. You refers to Users of Talenten’s services.
  7. User refers to any individual or organization using any aspect of the Talenten.vn website and/or Talenten.vn Services.
  8. User Content is all information, data, text, software, music, sound, images, graphics, videos, advertisements, messages, or other materials sent, posted, or represented by Users on or through the Talenten.vn website.

3. REGISTRATION

To use the services, you must create an account as required by Talenten. You commit that the use of your account must comply with Talenten’s regulations, and all information you provide to us is true, accurate, and complete at the time of request. Your rights and obligations will be based on the account information you have registered; therefore, if there is any discrepancy, we will not be responsible in the event that such information affects or limits your rights.

4. PASSWORD AND SECURITY

  1. When registering on the Talenten.vn website, you will be required to set up a password. To prevent fraud, you must keep this password secure and not disclose or share it with anyone. If you know or suspect that others know your password, you should immediately notify us by contacting us at admin@talenten.vn. 
  2. If Talenten.vn has reason to believe that there is a possibility of security breaches or misuse of the Talenten.vn website, we may ask you to change your password, or we may temporarily suspend your account. 
  3. In the event you lose your password or use the Talenten.vn website for improper purposes:
    • You must bear all resulting losses or damages, and
    • You are responsible for fully compensating Talenten in the event Talenten incurs any loss or damage.

5. ACCESS RIGHTS AND INFORMATION COLLECTION

  1. When using the Talenten.vn website, you acknowledge that we have the right to collect the following information from you (including all changes, updates, if any):
    • Personal information: includes information you provide to us to create a profile such as name, phone number, email address;…
    • General information: such as information about work experience, career orientation, job goals; competence level; income;…
  2. You acknowledge and agree to be solely responsible for the form, content, and authenticity of any profile or documents you upload to the Talenten.vn website, and you agree to be solely responsible for any consequences arising from such uploads. 
  3. Talenten has the right to propose services and products from third parties based on relevant items you identify while registering and anytime thereafter, and once you agree to receive these proposals, they will be implemented by Talenten or third parties. 
  4. Talenten may at its discretion comply with legal requirements, requests from law enforcement agencies, or requests from authorized agencies (“Third Party with Jurisdiction”), and this compliance may include disclosing certain user information. In addition, the Third Party with Jurisdiction may be allowed to retain copies of user information. 
  5. You understand and acknowledge that all information you provide, personal information, profiles, and/or account information (including all changes, updates, if any) will be disclosed to potential employers on Talenten with your consent. 
  6. Talenten absolutely respects the privacy rights of users. If you do not want your personal profile to be publicly disclosed, please turn off the job search feature and the feature that allows employers to view your profile to avoid any inconvenience. 
  7. You understand and acknowledge that you do not have ownership rights in your account, and if you cancel your account on the Talenten.vn website or your account is terminated, all your account information on the Talenten.vn website, including resumes, personal information, cover letters, saved jobs, will be marked for deletion and may be deleted from the Talenten database and removed from any public areas on the Talenten.vn website. Information may continue to be displayed for a period due to obstacles in signaling deletion through Talenten.vn servers or at the request of relevant authorities. In addition, third parties may be allowed to retain a copy of your information. 
  8. Talenten has the right to delete accounts and all your information after a period of inactivity. The duration is understood to be from … months and above. You need Talenten’s consent in case you want to restore the information.

6. DECLARATION ON INTELLECTUAL PROPERTY RIGHTS

  1. You declare and guarantee that: (i) you own the content you post on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms of Use; (ii) the posting and use of content on or through the Service does not violate, misappropriate, or infringe on the rights of any third party, including but not limited to privacy rights, publicity rights, copyrights, trademarks, and/or other intellectual property rights; (iii) you agree to pay all royalties, fees, and any other amounts owed in connection with the content you post on or through the Service; and (iv) you have the legal right and capacity to enter into these Terms of Use within your jurisdiction.
  2. The Service contains content owned or licensed by Talenten (“Talenten Content”). Talenten Content is protected by copyright, trademark, patent, trade secret, and other laws, and between you and Talenten, Talenten owns and retains all rights to the Service and Talenten Content. You may not remove, alter, or conceal any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying Talenten Content, and you may not copy, modify, adapt, prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license, or otherwise exploit Talenten Content.
  3. The logos and names of Talenten are trademarks of Talenten and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Talenten. Additionally, all page headers, custom graphics, button icons, and scripts are service marks, trademarks, and/or trade dress of Talenten and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Talenten.
  4. While Talenten aims to provide the most uninterrupted Service possible, there may be instances where the Service may be interrupted, including but not limited to interruptions for maintenance or upgrades on schedule, for emergency repairs, or due to equipment and/or telecommunications link failures. Additionally, Talenten reserves the right to remove any content from the Service for any reason, at its sole discretion, including but not limited to content that Talenten believes violates these Terms, violates the law, rules or regulations, is abusive, disruptive, offensive, or illegal, or violates the rights, or harms or threatens the safety of users of any Talenten website. Talenten has the right to expel users and restrict their access to the Talenten.vn website and/or use Talenten services if they violate these Terms or violate the law, rules, or regulations. Talenten may take any actions related to User Content as it deems necessary or appropriate if Talenten believes that User Content may create legal liability for Talenten, damage the Talenten brand or public image, or lead to Talenten losing users. Content deleted from the Service may continue to be stored by Talenten, including but not limited to storage to comply with certain legal obligations but may not be accessible without a valid court order. Talenten will not be legally responsible to you for any modifications, suspensions, or interruptions of any Service or the loss of any content. You also acknowledge that the Internet may not be secure and that sending content or other information may not be secure.
  5. Talenten is not responsible for any information posted by any third party, for any reason, by any organization that posts content on Talenten. However, Talenten will attempt to use all means to control and minimize cases of fraudulent job postings, incorrect information, etc., to protect Users. Talenten does not represent or warrant the truthfulness, accuracy, or reliability of User Content, derivative products from User Content, or any other contact information posted by Users and does not confirm any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users is at your own risk.

7. DISCLAIMER OF LIABILITY

  1. Talenten does not declare or warrant that the service will be error-free or uninterrupted; that defects will be corrected; or that the service or the server providing the service will be free of harmful components, including but not limited to viruses. Talenten does not make any specific statements or warranties that information (including any instructions) about the service is accurate, complete, or useful. You acknowledge that you use the service at your own risk. Talenten does not warrant that your use of the service is legal in any specific legal jurisdiction and Talenten disclaims any specific warranties. Some legal jurisdictions limit or do not allow disclaimers of implied warranties or other disclaimers, so the foregoing disclaimers may not apply to you within the legal jurisdiction that applies to you, and these Terms of Use.
  2. By accessing or using the Service, you declare and warrant that your activities are legal in every legal jurisdiction where you access or use the Service.
  3. Talenten does not confirm the content and specifically disclaims any liability or legal responsibility for any loss, damage (whether actual, consequential, punitive, or otherwise), injury, complaint, legal responsibility, or other cause under any form or characteristic based on or due to any content.

8. LIMITATION OF LEGAL LIABILITY

In any situation, Talenten shall not be legally responsible to you for any loss or damage of any form (including but not limited to any direct, indirect, economic, cautionary, special, punitive, accidental or consequential loss or damage) directly or indirectly related to: (a) the service; (b) Talenten content; (c) user content; (d) your use, inability to use, or effectiveness of the service; (e) any actions taken in connection with Talenten’s investigation or law enforcement agency regarding your use of the service or any other party; (f) any actions taken in connection with copyright or other intellectual property ownership; (g) any errors or omissions in the operation of the service; or (h) any damage to any user’s computer, mobile device, equipment, or other technology, including but not limited to damage caused by any security breach or any virus, error, imitation, fraud, error, deficiency, interruption, defect, delay, network error or machine error, including but not limited to damage caused by loss of profit, loss of reputation, loss of data, suspension of operations, accuracy of results, or computer error or malfunction, even if foreseeable, or Talenten has been advised or should have known of the possibility of such damages, whether based on contract, negligence, strict liability or personal fault (including, but not limited to, partially or wholly caused by negligence, force majeure, telecommunications errors, theft or destruction of services). In any case, Talenten shall not be legally responsible to you or anyone else for any loss, damage, or injury, including but not limited to personal injury or death.

9. DISPUTE RESOLUTION

  1. Any disputes arising during the use of Talenten’s services will be resolved according to the current laws of the Socialist Republic of Vietnam.
  2. Any complaints arising from the use of the product must be sent to Talenten immediately after the occurrence of the complaint event:

  3. Talenten will base each specific case to find a suitable resolution. When exercising the right to complain, the complainant is obliged to provide documents, evidence, and references related to the complaint and is responsible for the content of the complaint, documents, evidence, and references provided in accordance with the law.
  4. Talenten only supports and resolves complaints or reports from Users in cases where you have provided complete, honest, and accurate information when registering your account.
  5. For disputes between Users themselves or disputes with Third Parties, Talenten may provide contact information for the disputing parties to resolve themselves or Talenten will rely on the actual situation to resolve. Accordingly, Talenten will maximize the legal and just rights for Users.
  6. Users agree to protect, indemnify, and exclude Talenten from any legal obligations, litigation, losses, costs, including but not limited to attorney fees, consultant fees related to the resolution or arising from the User’s violation during the use of the product.
  7. If the dispute is not resolved within sixty (60) days from the date one party notifies the other in writing of the dispute, then either party has the right to bring the case to be resolved in a court with jurisdiction in Hanoi according to the law. The losing party must bear all litigation costs in court.

10. EFFECT

  1. The provisions of these Terms of Use may be updated, modified at any time without prior notice to users. Talenten will clearly announce on the Website about those changes, additions, and updates to you to obtain your consent. Forms of disclosure include but are not limited to email channels, Talenten account registration, and through notices displayed on our Website before applying the changes. In case you do not agree to Talenten’s updates or modifications, you cannot continue to use Talenten’s Service.
  2. In the event that one or more provisions of these Terms of Use conflict with the provisions of the law and are declared void by the Court, that provision will be modified to comply with current legal provisions, and the remaining part of these Terms of Use will still be valid.
  3. These Terms of Use are valid as a Contract. Users understand that this is an electronic contract, the Legal value of the electronic contract cannot be denied just because the contract is expressed in the form of data messages under the Law on Electronic Transactions. By clicking on the “I agree” button, you fully agree and understand the terms of this Contract, and the Contract takes effect from this moment. If you violate these Terms, you agree to be fully responsible and compensate for any damage (if any) to Talenten.
